Suspended Labour MP Mike Amesbury has been charged with assault following a 3am street clash.

Cheshire Police confirmed he has been summonsed to appear in court following the incident last month. Mr Amesbury, 55, who represents Runcorn and Helsby, is accused of assaulting a 45-year-old man in Frodsham on October 26.

Cheshire Police said in a statement: "A man has been summonsed to court in relation to an assault in Frodsham. Mike Amesbury MP, of Frodsham, Cheshire, has been summonsed to court to face the charge of section 39 assault.

"The 55-year-old is set to appear in magistrates court at a later date. The charge relates to reports of an assault on a 45-year-old man on Main Street, Frodsham, which was reported to police at 2.48am on Saturday 26 October."

The incident first came to light when mobile phone footage appeared to show the former shadow minister standing over a man who had been laid out on the pavement. The MP seemed to be telling him: "You won’t ever threaten me again."

CCTV recordings obtained by the Daily Mail, seem to show the backbencher throwing a punch at the man. He then appeared to hit him several times while on the floor.

On the day of the incident, Mr Amesbury said in a social media post: "Last night, I was involved in an incident that took place after I felt threatened on the street following an evening out with friends.

"This morning, I contacted Cheshire Police myself to report what happened during the incident. I will not be making further public comment but will, of course, co-operate with any inquiries if required by Cheshire Police.

"I remain fully committed to working hard for the people of Runcorn and Helsby, and am determined to remain an open and accessible MP for our community."

He was suspended by the Labour Party on October 27. A party spokesman said: “Mike Amesbury MP has been assisting Cheshire Police with their inquiries following an incident on Friday night.

"As these inquiries are now ongoing, the Labour Party has administratively suspended Mr Amesbury’s membership of the Labour Party pending an investigation.”

Rosemary Ainslie, head of the Crown Prosecution Service's Special Crime Division, said: "Following a review of the evidence provided by Cheshire Police, we have authorised a charge of common assault against Mike Amesbury MP, 55.

"The charge follows an alleged assault in Frodsham, Cheshire, on Saturday, October 26 2024. The Crown Prosecution Service reminds all concerned that criminal proceedings against the defendant are active and that he has the right to a fair trial.

"It is extremely important that there should be no reporting, commentary or sharing of information online which could in any way prejudice these proceedings."
